Welcome to the website of the Rural Oregon Community Foundation (“ROCF,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, related pages, forms, and online services (collectively, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Note: ROCF is a nonprofit organization focused on community support in rural Oregon. The Site is intended for general information, donations, grants, events, and volunteer engagement—not for commercial or for‑profit use.
1) Eligibility & Acceptable Use
By using the Site, you represent that you are at least the age of majority in your jurisdiction or have parental consent, and that you will use the Site only for lawful, noncommercial purposes.
You agree you will not:

2) Accounts; Security
Certain Site areas (e.g., event registrations, donor portals, or grant applications) may require an account. You are responsible for safeguarding your login credentials and for all activities on your account. Notify us immediately if you suspect unauthorized use.
3) Donations & Payments

Processing: Online payments may be processed by Wix Payments, Stripe, PayPal, or similar providers. ROCF does not store full payment card numbers.

Receipts: We issue receipts for donations as required by law.

Refunds: Donations are typically non‑refundable. If you believe an error occurred, contact us at info@ruraloregoncommunityfoundation.org within 30 days of the transaction.

Designations: We strive to honor donor designation preferences; if a program is fully funded or unavailable, ROCF may reallocate to similar purposes supporting our mission.

Recurring Gifts: You can modify or cancel recurring donations through the payment provider or by contacting us.
4) Programs, Grants & Events

Applications: Submitting a grant or program application does not guarantee funding or participation. ROCF reserves the right to approve, deny, or request additional information.

Event Changes: ROCF may reschedule, change, or cancel events due to circumstances beyond our control.

Eligibility & Compliance: Participants must meet eligibility requirements and comply with applicable laws, program rules, and safety guidelines.
5) User Content
If you submit or upload content to the Site (e.g., testimonials, photos, stories, application materials, or comments), you retain ownership of your content. By submitting it, you grant ROCF a non‑exclusive, royalty‑free, worldwide license to use, reproduce, display, and distribute the content for our nonprofit purposes (e.g., mission storytelling, program administration, and Site operation).
You represent and warrant that you have all necessary rights to submit the content and that it does not infringe any third party’s rights, contain confidential or proprietary information without authorization, or violate laws.
6) Intellectual Property
The Site and its content, including text, graphics, logos, photographs, videos, and software, are owned by or licensed to ROCF and protected by copyright, trademark, and other laws. Except as otherwise permitted, you may not copy, modify, distribute, display, or create derivative works from the Site or its content without our prior written consent.
Permitted Personal Use: You may download or print reasonable copies of Site materials solely for personal, noncommercial, mission‑aligned use, provided you do not modify or remove any notices.
7) Third‑Party Sites & Services
The Site may include links to third‑party websites or services (e.g., payment processors, event tools, partner organizations). ROCF does not control and is not responsible for third‑party content, policies, or practices. Your use of third‑party services is governed by their terms and policies.
8) Privacy, Cookies & Data
Your use of the Site is also governed by our Privacy Policy. We may use cookies and similar technologies (including Wix tools and Google Analytics, if enabled) to provide and improve the Site, understand usage, and remember preferences. You can manage some cookies through your browser settings and through our cookie banner (if enabled in Wix).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT.
11) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ROCF AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; ANY LOSS OF USE, DATA, OR PROFITS; OR ANY DAMAGES FOR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claims related to your use of the Site will not exceed $100 or the amount, if any, you paid to us for the specific service giving rise to the claim—whichever is greater.
Some jurisdictions do not allow certain limitations of liability; these limitations may not apply to you.
12) Indemnification
You agree to defend, indemnify, and hold harmless ROCF and its directors, officers, employees, volunteers, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your content, your violation of these Terms, or your violation of any rights of a third party.
13) Changes to the Site or These Terms
We may update the Site and these Terms from time to time. Changes are effective when posted, as indicated by the “Effective Date” above. Your continued use of the Site after changes are posted signifies your acceptance of the updated Terms.

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful to the Site, ROCF, or others.
15) Copyright & DMCA Notices
If you believe that any content on the Site infringes your copyright, please send a notice to info@ruraloregoncommunityfoundation.org with:

16) Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Oregon, without regard to its conflict‑of‑law rules.
Dispute Resolution: Before filing a formal claim, please contact us to try to resolve the issue informally. If unresolved, disputes shall be brought exclusively in the state or federal courts located in Oregon, and you consent to their jurisdiction and venue. You and ROCF each waive any right to a jury trial to the extent permitted by law.
For small claims within jurisdictional limits, you may bring an action in small claims court.
17) Severability; Waiver; Assignment
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. You may not assign any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, reorganization, or similar transaction.
18) Entire Agreement
These Terms, together with our Privacy Policy and any specific terms for particular programs or sections of the Site, constitute the entire agreement between you and ROCF concerning the Site and supersede any prior or contemporaneous communications.
